Fragments by Ferruccio de Bortoli | Hamas, the magistrates’ phrase “out of investigation”.

L’investigation that led to the arrest of nine alleged Hamas supporterswhich allegedly diverted Italian aid to the Palestinian population to the terrorist organization, deserves the utmost attention. Because it has great international relevance and throws a series of disturbing questions about the existence of an Islamic network in Europe. Returning to the events at home, the Genoese investigation should then induce those on the left who have too naively given credit to Mohammad Hannoun and his associates to ask themselves some questions beyond the principle of presumption of innocence which concerns everyone. And, at the same time, advise the majority not to fall into mere political exploitation. Those who expressed their solidarity with the inhabitants of Gaza and criticized the Netanyahu government are not, consequently, suspect of direct or indirect complicity with Hamas. It has raised some heated criticism, especially from exponents of the center-right (Maurizio Gasparri), the final sentence of the press release signed by the national anti-mafia and anti-terrorism prosecutor Giovanni Melillo and the Genoese public prosecutor, Nicola Piacente. «The investigations and the facts that emerged through them – they wrote – cannot in any way detract from the crimes committed against the Palestinian population after 7 October 2023 during military operations undertaken by the Government of Israelfor which judgment by the International Criminal Court is awaited.” In Giovanni Bianconi’s article, today in Corriere, Melillo explains the reasons for his choice, which was also appreciated by the Minister of the Interior, Matteo Piantedosi. He did not express a political opinion.
The Cartabia reform has reduced the power of prosecutors to speak with the press of their investigations to avoid justice show
(journalists’ fault) and better protect the presumption of innocence. Also implementing a European Parliament directive. And it had the paradoxical effect of force magistrates to justify issuing a press release with the public interest. It has effectively transformed them into improvised journalists or even, as in the case of the Genoese investigation, into historians and geopolitical experts. One wonders what will be said in other cases to justify the so-called public interest which will also be identified by the same magistrates whom the new legislation was intended to make less protagonists and less talkative. The pitfalls of the new rules had been clearly foreseen by a article by Luigi Ferrarella in the Corriere of 26 November 2021. Why be afraid of the correct and responsible work of journalists, preventing them from also checking the veracity of news, or presumed news, spread by so much powerful organized disinformation?
