L’AQUILA. The ASL has sued the Municipality of L’Aquila (there are two proceedings) because it disputes the requests for payment that the Authority has sent to the health company in relation to the “management” of spaces (but not only), inside the former Onpi. This is learned from two resolutions of the council that authorize the municipal attorney to appear in court. The first resolution states that “the ASL is bringing an action before the Court in opposition to the payment order issued by the Municipality – Institution of the senior citizens’ service center – for the recovery of the reimbursement quotas to be paid by the ASL relating to hospitalizations in the residential health care facility”. The second states that “the ASL is bringing an action before the Court in opposition to the payment order issued by the Municipality for the recovery of the large arrears of the ASL in relation to the payment of rental fees and accessories relating to the concession of portions of the former Onpi building for use as offices, hospice and RSA in Montereale”.
“To provide appropriate resistance”, it is underlined in the resolutions, “it is necessary that the council authorize the mayor’s appearance in court in relation to each state, phase and level of the proceedings”. The municipal statute, it is highlighted in the act “establishes that the mayor has the active and passive representation in court of the institution in each state and level of jurisdiction. When he deems it necessary, he can attribute the exercise of the representation to councilors or managers, granting them specific delegation”. (g.p.)
