VARESE -Husband and wife, both of North African origin, had argued, and for this reason she, born in 1978, had not told her husband that she would have to work the night shift at work, the same one that the man would have to do. Result: the minor children of the couple, resident in Varese, had slept at home alone, until the misunderstanding came to light, with a carabinieri patrol sent to the scene. The incident dates back to 2019 and cost the 46-year-old woman a trial on charges of child abandonment. A charge for which the public prosecutor, however, requested an acquittal.
«A big misunderstanding»
It was not abandonment of a minor, is the thesis expressed by the prosecutor in court in Varese. Reason? The absence of malice in the woman’s behavior, explained more directly – and outside of technicalities – by the defense attorney Julia Thomas: «There was just a big misunderstanding caused by the fact that the husband and wife didn’t get along at the time, and that day they hadn’t talked about their respective shifts».

In practice, the husband was at work thinking that his wife was at home, and she was calm thinking that her nephew was at home with the children, to whom she had already turned in the past to ask him to watch over them during her absence. He had sent him a message, but the relative had viewed it too late. For this reason, the husband of the woman who ended up on trial, once he was informed of the situation, became worried and contacted the police. The carabinieri arrived at the house and found the minors calm in their bed.
“No crime”
At the hearing, the defense obviously joined the request of the prosecutor: acquittal because the fact does not constitute a crime. And next October, almost five years after the event, the judge will decide whether or not to accept the requests of the parties.
