Acerra, new seizure of the Pellini brothers’ treasure

Acerra. The soldiers of the Economic-Financial Police Unit of the Guardia di Finanza of Naples have executed a release and restitution order issued by the Supreme Court of Cassation and, at the same time, a new seizure decree adopted by the Court of Naples – Section for the application of prevention measures, at the request of the local Public Prosecutor’s Office – District Anti-Mafia Directorate.

The decree concerns a huge estate with a total value of over 200 million euros, belonging to the brothers Giovanni, Cuono and Salvatore Pellini, entrepreneurs from Acerra active in various economic sectors, including the management of the recovery, disposal and recycling of urban and industrial waste.

In 2017, the assets of the aforementioned entrepreneurs had already been seized preventively following their final convictions for the crime of continued intentional disaster and the investigations by the GICO of Naples, which had detected a disproportion between the assets owned and their official declarations, demonstrating also that a large part of these assets derived from or had been reinvested in illicit activities.

The seized assets were then confiscated at first instance in 2019, with confirmation of the decree of the Court of Appeal of Naples filed on 19 June 2023.

With a sentence filed on 29 April 2024, the Sixth Criminal Section of the Court of Cassation annulled the decree of the Court of Appeal of Naples, ordering the return of the seized assets to those entitled to it.

Consequently, the General Prosecutor’s Office at the Court of Appeal of Naples has instructed the National Agency for the administration and destination of assets seized and confiscated from organized crime to execute this sentence, with the power to make use of the Guardia di Finanza of Naples.

At the same time, recognizing the possibility of issuing a new seizure order prior to confiscation, since the first ablative title had lapsed for formal reasons, the DDA of Naples delegated the Economic-Financial Police Unit to carry out a detailed reconnaissance of the assets of the interested parties.

On the basis of the investigations carried out, confirming the relevance of the subjective and objective assumptions of the first seizure, the Court of Naples – Section for the application of prevention measures, at the request of the DDA of Naples, has once again ordered the seizure of the following assets belonging to the entrepreneurs from Acerra and their family members: 8 companies, 72 vehicles, 75 financial reports, 224 properties, 75 lands, 3 boats and 2 helicopters, for a total estimated value of 201,476,743 euros.
